The Service is operated by Pragmatic Solutions LLC("Company," "we," "us," or "our").
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Service Description
Tratly is an AI-powered real estate SaaS (Software as a Service) platform designed for real estate agents, brokers, and agencies. The platform provides tools including but not limited to:
- Customer Relationship Management (CRM) and sales pipeline
- Property listing management with AI-generated descriptions
- AI-powered lead scoring and analytics
- Communication hub with WhatsApp and email integration
- Document generation and management
- Marketing suite with AI content creation
- Client portals and property sharing
- Real-time analytics and market insights
2. Account Terms
To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access to your account
- Ensuring that all information you provide is truthful and up to date
You must be at least 18 years old to create an account and use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
3. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
- Upload, post, or transmit any content that is fraudulent, misleading, defamatory, or infringing
- Attempt to gain unauthorized access to the Service, other accounts, or related systems
- Interfere with or disrupt the integrity or performance of the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to send unsolicited communications (spam)
- Resell, sublicense, or redistribute the Service without prior written consent
- Use automated tools to scrape, harvest, or extract data from the Service
We reserve the right to suspend or terminate accounts that violate these Terms or engage in activity that is harmful to other users or the Service.
4. Free Trial
Tratly offers a 30-day free trial that provides full access to the platform and all its features, including the complete AI suite. The free trial:
- Does not require a credit card to start
- Provides access to all features available in the plan you select
- Automatically ends after 30 days unless you subscribe to a paid plan
- May be limited to one trial per person or organization
At the end of the trial period, if you do not subscribe, your access to paid features will be restricted. Your data will be retained for a reasonable period to allow you to subscribe and resume use.
5. Subscription and Billing
Tratly offers the following subscription plans:
- Starter: $49 per month -- for individual agents
- Professional: $79 per month -- for active agents and small teams
- Agency: $129 per month -- for teams and brokerages
All prices are in US dollars and are subject to change with prior notice. Subscriptions are billed on a recurring monthly basis. By subscribing, you authorize us to charge your designated payment method for recurring fees.
You may upgrade or downgrade your plan at any time. Plan changes take effect at the start of the next billing cycle. If you upgrade, you may be charged a prorated amount for the remainder of the current billing period.
All fees are non-refundable except as required by applicable law or as explicitly stated in these Terms.
6. Data Ownership
You own your data.All property data, contact information, documents, communications, and any other content you upload, create, or generate through the Service ("Your Data") remains your property.
By using the Service, you grant us a limited, non-exclusive license to use Your Data solely for the purpose of providing and improving the Service. We will not sell, share, or use Your Data for purposes unrelated to the Service without your explicit consent.
You may export Your Data at any time through the platform's export features. Upon termination of your account, we will make Your Data available for export for a reasonable period.
7. AI-Generated Content Disclaimer
The Service uses artificial intelligence to generate property descriptions, lead scores, market insights, email drafts, pricing suggestions, and other content ("AI-Generated Content"). You acknowledge and agree that:
- AI-Generated Content is provided as a tool to assist you and should be reviewed before use
- AI-Generated Content does not constitute legal, financial, investment, appraisal, or professional advice
- AI-generated pricing suggestions and market insights are estimates based on available data and may not reflect actual market conditions
- You are solely responsible for reviewing, editing, and verifying all AI-Generated Content before sharing it with clients or third parties
- We do not guarantee the accuracy, completeness, or suitability of any AI-Generated Content
You should always consult qualified professionals for legal, financial, tax, and appraisal matters related to real estate transactions.
8. Intellectual Property
The Service, including its design, code, features, documentation, trademarks, and all related intellectual property, is owned by Pragmatic Solutions LLC and is protected by applicable intellectual property laws. These Terms do not grant you any rights to use our trademarks, logos, or branding without prior written consent.
9. Termination and Cancellation
By you: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until the end of your paid period. No partial refunds will be issued for unused time.
By us: We may suspend or terminate your access to the Service at any time if you violate these Terms, engage in fraudulent or abusive conduct, or for any reason with reasonable notice. In cases of severe violations, termination may be immediate and without notice.
Upon termination, your right to use the Service ceases. We will retain Your Data for a reasonable period to allow for export, after which it may be deleted.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement
- We do not warrant that the Service will be uninterrupted, error-free, or secure
- In no event shall Pragmatic Solutions LLC, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses
- Our total aggregate liability for any claims arising from or related to the Service shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim
11. Indemnification
You agree to indemnify, defend, and hold harmless Pragmatic Solutions LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
12. Modifications to Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes.
13. Governing Law
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from or related to these Terms or the Service shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration or in the courts of competent jurisdiction.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
